Appeal Court Still To Rule, Metouck's Hearing Adjourned Again

While waiting for the ruling by the Appeal Court on the recusation forwarded by the accused, the case has been adjourned to March 25.

The Limbe Court of First Instance was once again thronged by a mammoth crowd who answered present yesterday to hear the verdict of case file Number CFIL/820/2013 pitting the People of Cameroon versus Charles Metouck (the erstwhile SONARA General Manager) , Edinguelle Edinguelle Jean Jules and Ngalle Mouelle Noe. The three are being accused of usurpation of office according to Section 216 (2) of the Criminal Procedure Code alongside 19 other counts.

After asking the Defense Counsel if the Appeal Court has reacted to the recusation in which the defense asked for the presiding magistrate to be changed, it took less than 10 minutes for His Worship Justice Tatsi Theophilus (President of the Limbe Court of First Instance) to adjourn the high-profile case to March 25. He got no reply from the Defense Counsel.

But Barrister Nguemako Maurice Welabi, who leads the Defense Counsel of the First and Second accused, informed Cameroon Tribune that "The Court of Appeal in Buea has not yet ruled on the recusal forwarded by the accused for the presiding Magistrate to be changed. Until the Appeal Court rules either for him to continue hearing the case or for a new Magistrate to be appointed; then the case will keep on being adjourned until there is a ruling."

Metouck, who is under pre-trail detention alongside two others at the Buea Central Prison, have requested that the President of the Limbe Court of First Instance, Tatsi Theophilus, who is hearing the case be changed. Lawyer Blaise Mbita made the recusal submission Monday 11 March during the third hearing of the case pitting the People of Cameroon versus Charles Metouck, Edinguelle Edinguelle Jean Jules and Ngale Mouelle Noe over usurpation of office, destruction of documents belonging to SONARA amongst other counts. Meanwhile, the three suspects were remanded to their prison cells at the Buea Central Prison under tight security.
