CDC Embezzlement Case: Prosecution Presents Four Witnesses

Hearing on the matter is expected to begin on August 7, 2015 at the Special Criminal Court.

Matters in the case between the people of Cameroon and State of Cameroon; Cameroon Development Corporation (CDC) against Oteil Mbua Gabriel and six others was called up for the second time at the Special Criminal Court (SCC) on Thursday, July 2, 2015. During the court session that lasted about an hour, the Head of the Panel of Judges, Mr Justice Richard Wanki took time to regularise certain legal issue regarding the hearing of the case.  

During the court session, two accused persons; (the first accused, Otiel Mbua Gabriel and the third accused, Daniel Njiki) who had not yet pleaded guilty or not guilty to the cases levied against them did so and the court assigned lawyers to defend them. The law stipulates that in a case where an accused person in the SCC does not have a lawyer, the court assigns a lawyer to the accused person because the court and the crime is that which has a magnitude which needs to be defended with a lot of technicality and that can be done only by a lawyer and not the accused person himself.  After Otiel Mbua and Daniel Njiki pleaded not guilty to the charges, the court decided to find out if all the accused persons can speak or understand the French language of which they said no.

The Legal Department headed by Advocate General Regine Esseneme also presented a list of four witnesses, while the accused persons said they do not have any witnesses. Mr Justice Richard Wanki and the crew of judges suspended the matter to August 7, 2015, for the prosecution witness to appear in court, for hearing on the matter to start   and for the Civil Party lawyer to regularise his constitution in the matter, since he filed in his application to be constituted in the matter at the Ministry of Justice and the Ministry has the right to authenticate and later send to the court before he can appear in court and defend the State in the matter.

According to the case file, Oteil Mbua Gabriel, Ngomba Jonathan Monika, Njiki Daniel, Lyonga Nganje William, Hali Gabila, Mkpot Roland and Babila Protus Ndibnu are accused to have at Tiko and Limbe-Bota, within the jurisdiction of the SCC during 2012 and 2013, together and in agreement as co-offenders by any means took or kept dishonestly the property of CDC at the sum of FCFA 360.936.854 being value of 707,872 litres of fuel illegally removed from the said corporation. This is an offence contrary to and punishable under sections 74, 96 and 184 (1), (9) of the Penal Code.
